Tuesday, October 6, 2015Once a bankruptcy order has been made by the court, a trustee in bankruptcy will be appointed to collect in and sell the bankrupt's assets for the benefit of the creditors. As at the date of the order, the bankrupt's estate vests in the trustee. This note defines the 'bankruptcy estate' and looks at the treatment of income, pension and matrimonial home on bankruptcy. It also considers the circumstances where assets disposed of by the bankrupt before the commencement of the bankruptcy may be reclaimed by the trustee and the treatment of after-acquired property.
